The Kolkata High Court has refused to grant an interim stay on Assembly Speaker Radhindra Bose’s decision to appoint dissatisfied Trinamool Congress MLA Ritabrata Banerjee as the Leader of the Opposition in the Legislative Assembly.
BJP won the West Bengal Assembly election and formed the government. The Trinamool Congress won only 80 seats, lost the election, and lost power. Following this, a split has emerged among the party’s MLAs. Senior MLA Ritabrata Banerjee is leading the dissident faction. Based on a letter submitted by Ritabrata Banerjee stating that he has the support of 58 Trinamool Congress MLAs, Assembly Speaker Ratindra Bose appointed him as the Leader of the Opposition in the Assembly.
At the same time, the Speaker rejected the letter submitted by MLA Sobhandeb Chattopadhyay, who belongs to the Mamata Banerjee-supporting faction, requesting that he be appointed as the Leader of the Opposition. Following this, Sobhandeb Chattopadhyay filed a case in the Calcutta High Court challenging the rejection of his letter and the Speaker’s appointment of Ritabrata Banerjee as the Leader of the Opposition in the Legislative Assembly.
This case came up for hearing in the Calcutta High Court on Thursday. At that time, pointing out that the budget session is currently under way in the West Bengal Legislative Assembly, the High Court said that Ritabrata Banerjee and others appointed by the Speaker as Leader of the Opposition could continue in their respective roles. The High Court also noted that an interim stay cannot be granted on the Speaker’s decision, and that the court does not wish to intervene in the matter at present.
The Calcutta High Court adjourned the next hearing in the case to the 28th of this month.
