Munusamy is from the Kottucherry area in Karaikal district, Puducherry. Munusamy, who lost his wife, is now 84 years old. He has three sons: Varadarajan, Thirumurugan, and Meenakshi Sundaram.
They have been living in the Thirupattinam area and have left their father Munusamy alone for many years without providing any kind of care, including food and medical treatment. Frustrated by this, Munusamy filed a petition in the Karaikal Sub Court in 2018, saying, `My sons took everything from me in my old age and then abandoned me without taking care of me.
I, an old man, do not even have a way to eat. Not even one of my three sons gives me food,' he stated in the petition.
Following that, the then Subordinate Court judge and Deputy Collector Adarsh took up and heard the petition filed by the elderly man Munusamy under the Maintenance and Welfare of Parents and Senior Citizens Act.
It was found that Munusamy’s three sons had abandoned him without taking care of him. Therefore, Deputy Collector Adarsh ordered that all three sons must each pay Munusamy Rs. 2,000 every month. If they fail to do so, they will be sentenced to imprisonment, he ordered.
At that time, Munusamy’s three sons, who had agreed to it, appealed to the District Collector saying that they could not pay the maintenance amount thereafter. However, the District Collector dismissed that appeal petition.
Following that, one of Munusamy’s sons, Thirumurugan, appealed in the Madras High Court. But there too, the judges dismissed the petition. Subsequently, another son, Meenakshi Sundaram, appealed in the Madras High Court.
However, no order has been issued on that petition so far. It was in this situation that elderly Munusamy once again approached the maintenance tribunal, saying, “Even though the subordinate court ordered it, my sons have not provided me any maintenance from 2018 to 2026.”
After hearing his petition, the maintenance tribunal judge and district sub-collector, Pooja, gave all three sons a stern dressing-down.
He then ordered the police to “arrest all three for delaying payment of maintenance for 71 months and for contempt of the court’s judgment.” Accordingly, Munusamy’s three sons, who were arrested, were produced before Judge Pooja on the 5th.
After the hearing held then, he ruled that, under the Maintenance and Welfare of Parents and Senior Citizens Act, the three were each sentenced to one month in prison for failing to pay maintenance.
Furthermore, the three of them must remain in prison until the maintenance amount is paid. After that, they must pay maintenance to the elderly man Munusamy every month without fail,” he also ordered. Following that, all three were lodged in Karaikal prison.

புதுச்சேரி, காரைக்கால் மாவட்டம் கோட்டுச்சேரி பகுதியைச் சேர்ந்தவர் முனுசாமி. மனைவியை இழந்த முனுசாமிக்கு தற்போதைய வயது 84. இவருக்கு வரதராஜன், திருமுருகன், மீனாட்சி சுந்தரம் என மூன்று மகன்கள் இருக்கின்றனர்.

அதையடுத்து சென்னை உயர் நீதிமன்றத்தில் முனுசாமியின் மகன்களில் ஒருவரான திருமுருகன் மேல் முறையீடு செய்தார். ஆனால் அங்கும் அந்த மனுவை தள்ளுபடி செய்தனர் நீதிபதிகள். தொடர்ந்து மற்றொரு மகனான மீனாட்சி சுந்தரம் சென்னை உயர் நீதிமன்றத்தில் மேல் முறையீடு செய்தார்.

தொடர்ந்து, `71 மாதங்களுக்கான பராமரிப்புத் தொகை வழங்காமல் காலம் தாழ்த்தியதற்கும், நீதிமன்றத்தின் தீர்ப்பை அவமதித்ததற்காகவும் மூவரையும் கைது செய்யுங்கள்’ என்று காவல்துறைக்கு உத்தரவிட்டார். அதன்படி கைது செய்யப்பட்ட முனுசாமியின் மூன்று மகன்களும், கடந்த 5-ம் தேதி நீதிபதி பூஜா முன்பு ஆஜர்படுத்தப்பட்டனர்.
அப்போது நடைபெற்ற விசாரணைக்குப் பிறகு, பெற்றோர்கள் மற்றும் மூத்த குடிமக்கள் பாதுகாப்புச் சட்டத்தின்படி பராமரிப்புத் தொகை வழங்காததால் மூவருக்கு தலா ஒரு மாதம் சிறைத் தண்டனை விதித்து தீர்ப்பளித்தார்.
மேலும், பராமரிப்புத் தொகையை வழங்கும் வரை மூன்று பேரும் சிறையில் இருக்க வேண்டும். அதன்பிறகு மாதம் தவறாமல் முதியவர் முனுசாமிக்கு பராமரிப்புத் தொகையை வழங்க வேண்டும்’ என்றும் உத்தரவிட்டார். அதையடுத்து அவர்கள் மூன்று பேரும் காரைக்கால் சிறையில் அடைக்கப்பட்டனர்.
