Chennai: In the ongoing case filed by the AIADMK whip challenging the acceptance of the resignations of AIADMK MLAs, the High Court has issued notices to the Speaker of the Assembly, the Assembly Secretary, and others to file a response.
In the Legislative Assembly on May 13, during the confidence vote on the TVK government, 25 AIADMK MLAs, led by former minister C.V. Shanmugam and S.P. Velumani, voted in support of TVK. Following this, AIADMK General Secretary Palaniswami submitted a petition to Speaker J.C.D. Prabhakar seeking the disqualification of all 25 of them under the anti-defection law.
In this situation, AIADMK MLAs Madurantakam Maragatham Kumaravel, Perundurai Jayakumar, Dharapuram Sathiyabama, and Ambasamudram Isakki Subbiah submitted letters to the Speaker stating that they were resigning from their MLA posts, and immediately joined the TVK.
With a petition already pending under the anti-defection law seeking their disqualification, AIADMK whip Agri Krishnamurthy said that the Speaker’s acceptance of their resignations was illegal,
National People’s Power Party leader M.L. Ravi and others separately filed cases in the Chennai High Court. They had requested that “the four who resigned should not be allowed to contest the election again. Until this case is resolved, an order should be issued prohibiting the announcement of by-elections in the four constituencies.”
The case came up for hearing before Chief Justice S.A. Dharmadhikari and Justice G. Arulmurugan.
Then, senior advocate S.R. Rajagopal, appearing for petitioner Agri Krishnamurthy, said, “When the resignation letter was submitted at 2:30 p.m., the Speaker accepted the resignation at 3:30 p.m. and it was immediately published in the Gazette. Before accepting their resignation, the Speaker did not conduct the proper inquiry.”
The court cannot interfere
Appearing on behalf of the Secretary of the Legislative Assembly, Tamil Nadu government’s Advocate General Vijay Narayan said, “The Speaker has accepted the resignation letter by following the proper procedures and has duly informed it. There is no time limit for the Speaker’s actions. In particular, the court cannot interfere in the Speaker’s actions,” he said.
After hearing arguments from both sides, the judges said, “The court cannot interfere in all the proceedings of the Legislative Assembly. Therefore, no interim order can be issued in this case.” They rejected the request. They also issued notices for the Speaker of the Assembly, the Assembly Secretary, and the four former MLAs involved in the case to respond, and adjourned the hearing to June 29.
Explanation from the Speaker
