Congress leader Meenakshi Natarajan said on Friday that there was no information in the Election Commission’s Form 26 to record regarding the statutory notice.
Congress leader Meenakshi Natarajan had filed her nomination as the opposition candidate in the Rajya Sabha election that was to be held in Madhya Pradesh. In this situation, BJP candidate Mahesh Kewat had complained to the Election Commission that Meenakshi Natarajan had not mentioned in her nomination that a complaint had been filed against her in court. After investigating the matter, the Election Commission rejected Meenakshi Natarajan’s nomination.
As a result, Meenakshi Natarajan filed a petition in the Supreme Court challenging the rejection of her nomination. Speaking about this, she said:
Since this matter falls within the court’s jurisdiction, it is being heard today in the Supreme Court. The reason for this entire issue is Form 26. It alleged that I had failed to record certain information and had concealed facts.
The form states that if any criminal case is pending, or if a person has been convicted of an offense punishable by law, that information must be provided.
Therefore, I marked all of these as 'not applicable.' There is only one legal notice against me. I had included all the legal details regarding that notice in the memorandum I submitted to the Election Commission.
In Form 26, there is no paragraph stating that information related to personal complaints must also be provided. Meenakshi Natarajan said that if such a paragraph had been there, we would have provided that information from our side.
In this situation, it is noteworthy that all three candidates who contested on behalf of the BJP in Madhya Pradesh had already been elected unopposed.
