Madurai: “The government must properly follow the laws and government orders for persons with disabilities. They cannot be brushed aside by citing administrative reasons,” the Madurai Bench of the High Court has said.
In the Tamil Nadu Animal Husbandry Department, Dr. Arun Kumar is working in Tenkasi district. He is a person with a disability.
He had applied for a transfer to the Rayagiri Veterinary Dispensary in Tenkasi district on Sept. 24, 2025. In this situation, on March 13, 2026, the Director of the Animal Husbandry Department, S.P. Amrith, had ordered the appointment of another veterinary doctor at the Rayagiri Veterinary Dispensary. Dr. Arun Kumar had filed a case in the Madurai Bench of the High Court challenging this transfer order.
In the order issued by Judge Mumminini Sudeep Kumar, who heard this case: “The government must properly follow the laws and government orders relating to persons with disabilities. It cannot dismiss them by citing administrative reasons. Rejecting the petitioner’s request for a transfer is unacceptable.
The Director of the Animal Husbandry Department has acted negligently and arbitrarily and has failed to discharge his statutory duty. Therefore, the Judge directed the Director of the Animal Husbandry Department to consider the petitioner’s transfer application in accordance with the law and take an appropriate decision within six weeks.”

இந்த வழக்கை விசாரித்த நீதிபதி மும்மினினி சுதீப் குமார் பிறப்பித்த உத்தரவில்: ”மாற்றுத் திறனாளிகளுக்கான சட்டங்களையும், அரசாணைகளையும் அரசு முறையாக பின்பற்ற வேண்டும். நிர்வாகக் காரணம் என்று கூறி புறம் தள்ள முடியாது. மனுதாரரின் பணியிட மாறுதல் கோரிக்கையை நிராகரித்தது ஏற்றுக்கொள்ள முடியாதது.
கால்நடை பராமரிப்புத் துறை இயக்குநர், கவனக் குறைவாகவும், தன்னிச்சையாகவும் செயல்பட்டு, தனது சட்டபூர்வமான கடமையை நிறைவேற்ற தவறியுள்ளார். எனவே கால்நடை பராமரிப்புத் துறை இயக்குநர், ஆறு வாரங்களுக்குள் மனுதாரரின் பணியிட மாறுதல் விண்ணப்பத்தை சட்டப்படி பரிசீலித்து உரிய முடிவெடுக்க” நீதிபதி உத்தரவிட்டார்.
