Chennai: The Chennai High Court has dismissed the petition filed by DMK MLA Markandeyan, who had sought to quash the order remanding him to prison after he was arrested for allegedly speaking in a threatening manner toward the Chief Minister.

DMK MLA from Vilathikulam Markandeyan, who spoke at a thanksgiving meeting for voters in Kovilpatti in Thoothukudi district, was arrested by the Thoothukudi district crime branch police after a case was registered against him for allegedly making threatening remarks toward the Chief Minister.

Meanwhile, a petition had been filed on Markandeyan’s behalf in the Chennai High Court seeking to quash the order remanding him to prison.

This petition was heard by Judge G.K. Ilanthiraiyan. At that time, on behalf of MLA Markandeyan, it was argued that, “He spoke only in response to the Chief Minister, who said that the Legislative Assembly would be locked. There was no ulterior motive in it. Since the Magistrate has mechanically ordered that he be imprisoned, the order imprisoning the petitioner should be set aside.”

On the police side, it was argued that, “With the Legislative Assembly in session, it is not possible to verify whether this threat is real. This was a statement made in public. If no arrest action is taken, he may repeat the same offense. The magistrate ordered detention in prison only after examining all the documents and being satisfied. There is nothing wrong with that order.”

After hearing arguments from both sides, the judge had reserved the order on the petition without specifying a date.

In this situation, when the case came up for hearing again today, the judge dismissed the petition filed by DMK MLA Markandeyan challenging the order of detention. It is noteworthy that Markandeyan had already been released on conditional bail in this case.

இதனிடையே, தன்னை சிறையிலடைத்த உத்தரவை ரத்து செய்யக் கோரி மார்க்கண்டேயன் தரப்பில் சென்னை உயர் நீதிமன்றத்தில் மனு தாக்கல் செய்யப்பட்டிருந்தது.

இந்த மனுவை நீதிபதி ஜி.கே.இளந்திரையன் விசாரித்தார். அப்போது எம்எல்ஏ மார்க்கண்டேயன் தரப்பில், ‘சட்டமன்றம் பூட்டப்படும் எனக் கூறிய முதல்வருக்கு பதிலளிக்கும் வகையில் தான் பேசியுள்ளார். அதில் எந்த உள்நோக்கமும் இல்லை. மாஜிஸ்திரேட் இயந்திரத்தனமாக சிறையில் அடைத்து உத்தரவிட்டுள்ளதால், மனுதாரரை சிறையில் அடைத்த உத்தரவை ரத்து செய்ய வேண்டும்’ என வாதிடப்பட்டது.

காவல் துறை தரப்பில், ‘சட்டமன்றம் கூட உள்ள நிலையில் இந்த மிரட்டல் உண்மையா என சோதிக்க முடியாது. பொதுவெளியில் பேசிய பேச்சு இது. கைது நடவடிக்கை எடுக்காவிட்டால் இதே குற்றத்தை அவர் மீண்டும் செய்யக் கூடும். மாஜிஸ்திரேட் அனைத்து ஆவணங்களையும் ஆய்வு செய்து திருப்தியடைந்த பிறகே சிறையில் அடைக்க உத்தரவிட்டுள்ளார். அந்த உத்தரவில் எந்த தவறும் இல்லை’ என வாதிடப்பட்டது.

இந்நிலையில், இன்று வழக்கு மீண்டும் விசாரணைக்கு வந்தபோது, சிறையில் அடைத்த உத்தரவை எதிர்த்து திமுக எம்எல்ஏ மார்க்கண்டேயன் தாக்கல் செய்த மனுவை நீதிபதி தள்ளுபடி செய்து உத்தரவிட்டார். இந்த வழக்கில் மார்க்கண்டேயன் ஏற்கெனவே நிபந்தனை ஜாமீனில் விடுவிக்கப்பட்டது குறிப்பிடத்தக்கது.
