"The Supreme Court said on Tuesday that the Tamil Nadu government may permit fishing using trawl nets beyond 12 nautical miles, in accordance with legal regulations in Tamil Nadu. Further, after completing the hearing of this case, the Supreme Court has reserved its judgment without specifying a date.
The Tamil Nadu government issued an order on February 17, 2020, imposing a ban on the use of trawl nets. Against this, appeal petitions were filed in the Supreme Court on behalf of fishermen’s organizations.
This case came up for hearing in the Supreme Court on Tuesday before a bench comprising Justices B. S. Narasimha and A. Oka.
Then, Additional Solicitor General of the Central Government K.M. Nataraj appeared and argued: "The committee constituted to study the use of purse seine nets for fishing submitted its report on May 2, 2024. The Central Government accepted that report. Following that, regulations were framed on November 4, 2025.
Accordingly, there is no prohibition on fishing using purse seine nets. The state government may regulate the guidelines regarding permitting the use of purse seine nets up to a distance of twelve nautical miles in the sea. However, the sea area beyond 12 nautical miles is under the control of the central government. There, there is no restriction on fishing using purse seine nets,' K.M. Nataraj noted.
Following this, the judges told Tamil Nadu government counsel Sanjay Hegde, "The Central Government has framed rules and regulations regarding permitting fishing using purse seine nets. Even after that, how can you say that purse seine nets cannot be permitted? Legal rules allow fishing using purse seine nets beyond 12 nautical miles. On that basis, shouldn’t the Tamil Nadu government also grant permission? They asked. They further said, 'You may arrest those who fish using purse seine nets in the sea areas within the Tamil Nadu government’s jurisdiction, within the 12-nautical-mile limit, in violation of the rules. But refusing permission to fishermen who go fishing beyond 12 nautical miles raises suspicion.'"
Following this, the judges, who ordered the Central Government to submit details on how the legal regulations related to the purse seine net are being followed in other states, concluded the hearing in this matter and reserved the verdict without specifying a date.
