Horse name controversy: High Court stays the investigation into the Triplicane police station case

Chennai: The Chennai High Court has ordered a stay on the entire investigation into the case registered at the Triplicane police station alleging horse-trading with a TVK MLA.

In the Legislative Assembly, it was alleged that a motion would be brought against Speaker J.C.D. Prabhakar, and that even though he was a member of the ruling TVK party, a deal was struck offering up to Rs. 35 crore as a reward if they acted as instructed during the vote on that motion, TVK MLA from the Uthangarai constituency N. Ilayaraja had filed a complaint with the Chennai Police Commissioner.

Accordingly, in the case registered at the Triplicane police station, 14 people, including YouTuber Thirunavukkarasu from Arumbakkam, Chennai; Naresh from Tiruchi; and Thyagarajan from Medavakkam, Chennai, have been arrested.

In this case, while Ashok Kumar, the brother of former DMK minister Senthil Balaji, has been included, both have obtained anticipatory bail from the Madras High Court.

In this case, Ramesh, who was arrested and later granted bail, had filed a petition seeking an order to transfer the case registered at the Triplicane police station regarding the horse-trading allegations to the CBI. In that petition, the court had directed the Central and State governments and the CBI to respond, and had imposed a stay only on the investigation against Ramesh.

In this situation, Sethu Raj and Karthik, who were granted bail yesterday, have also filed petitions in the Madras High Court seeking that this case be transferred to a CBI investigation and that the CBI be directed to conduct a fresh investigation.

When these cases came up for hearing before the bench comprising Chief Justice Sushrut Aravind Dharmadhikari and Justice G. Arulmugan, the petitioners argued, “We have no confidence in the state police’s investigation, so this case should be transferred to the CBI or some other investigating agency.”

On behalf of the police, it was stated, “There is no need to fabricate a false case. Evidence has been collected.”

Further, on behalf of the Tamil Nadu government, it was argued, “Since the investigation in the case is at an early stage, no interim order should be issued.”

After hearing arguments from all sides, the judges pointed out that the accused persons have been filing petitions one by one seeking transfer of the case to a CBI investigation, and ordered a stay on the overall investigation into the case registered at the Triplicane police station in connection with horse-trading. The judges also adjourned the hearing of the case to August 27.

இந்த வழக்கில் கைதாகி ஜாமீன் பெற்ற ரமேஷ் என்பவர், குதிரை பேரம் பேசப்பட்டது தொடர்பாக திருவல்லிக்கேணி காவல் நிலையத்தில் பதிவு செய்துள்ள வழக்கை சிபிஐ-க்கு மாற்ற உத்தரவிடக் கோரி தாக்கல் செய்த மனுவில், மத்திய - மாநில அரசுகள், சிபிஐ ஆகியோர் பதிலளிக்க உத்தரவிடப்பட்டு, ரமேஷ் மீதான விசாரணைக்கு மட்டும் தடை விதிக்கப்பட்டிருந்தது.

இந்த நிலையில், நேற்று ஜாமீன் பெற்ற சேதுராஜ், கார்த்திக் ஆகியோரும் இந்த வழக்கை சிபிஐ விசாரணைக்கு மாற்ற வேண்டும் என்றும், புதிதாக விசாரணை நடத்த சிபிஐ-க்கு உத்தரவிட வேண்டும் என்றும் கோரி சென்னை உயர் நீதிமன்றத்தில் வழக்குகளை தாக்கல் செய்துள்ளனர்.

இந்த வழக்குகள் தலைமை நீதிபதி சுஷ்ருத் அரவிந்த் தர்மாதிகாரி மற்றும் நீதிபதி ஜி.அருள்முருகன் அடங்கிய அமர்வில் விசாரணைக்கு வந்தபோது, மனுதாரர்கள் தரப்பில் “மாநில காவல் துறையினர் விசாரணையில் நம்பிக்கை இல்லை என்பதால் இந்த வழக்கை சிபிஐ அல்லது வேறு ஏதேனும் விசாரணை அமைப்புக்கு மாற்ற வேண்டும்” என்று வாதிடப்பட்டது.

காவல்துறை தரப்பில், “பொய் வழக்கு ஜோடிக்க அவசியம் இல்லை. ஆதாரங்கள் சேகரிக்கப்பட்டுள்ளன” என்று தெரிவிகக்கப்பட்டது.

மேலும் தமிழக அரசு தரப்பில், “வழக்கின் புலன் விசாரணை ஆரம்ப கட்டத்தில் உள்ளதால் எந்த இடைக்கால உத்தரவும் பிறப்பிக்க கூடாது” என்று வாதிடப்பட்டது.

அனைத்து தரப்பு வாதங்களையும் கேட்ட நீதிபதிகள், குற்றம்சாட்டப்பட்ட நபர்கள் ஒவ்வொருவராக சிபிஐ விசாரணைக்கு மாற்றக் கோரி மனுத் தாக்கல் செய்துவருவதை சுட்டிக்காட்டி, குதிரை பேரம் தொடர்பாக திருவல்லிக்கேணி காவல் நிலையத்தில் பதிவு செய்யப்பட்ட வழக்கின் ஒட்டுமொத்த விசாரணைக்கும் தடை விதித்து உத்தரவிட்டனர். மேலும் வழக்கின் விசாரணையை ஆகஸ்ட் 27-ம் தேதிக்கு ஒத்திவைத்து நீதிபதிகள் உத்தரவிட்டுள்ளனர்.
