The Supreme Court has stated that police excesses cannot be justified.

The Supreme Court had agreed to hear today petitions alleging that police had used excessive force against students who protested over the NEET question paper leak and other examination irregularities.

A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V. Mohana said it would hear tomorrow the petition filed by family members of police officers who were attacked during the protest, along with the other listed petitions.

Chief Justice Surya Kant said, “The right to protest peacefully is fully guaranteed. It cannot be denied. Likewise, police excesses cannot be justified merely because a protest is taking place.

There must be a procedure for this. A proper place should be allotted, and restrictions should not be imposed. However, if there are anti-social elements, they can be dealt with. This is not just an issue concerning Delhi. Proper norms must be followed,” he said.

When the lawyer said that the police had been attacked, the judge stated, “Whoever it may be, every person’s life is important.” The judge also urged the petitioners to assist the court without confrontation.

Solicitor General Tushar Mehta, appearing on behalf of the Central Government, stated that they would assist the court in an impartial manner.

Following this, the bench of judges agreed that the petitions would be heard tomorrow.

நீட் வினாத்தாள் கசிவு மற்றும் பிற தேர்வு முறைகேடுகள் தொடர்பாகப் போராடிய மாணவர்கள் மீது காவல்துறை அத்துமீறலில் ஈடுபட்டதாகக் கூறப்படும் மனுக்களை இன்று விசாரிக்க உச்சநீதிமன்றம் ஒப்புக்கொண்டிருந்தது.

தலைமை நீதிபதி சூர்ய காந்த் மற்றும் நீதிபதிகள் ஜாய்மால்யா பாக்சி, வி. மோகனா ஆகியோர் அடங்கிய அமர்வு, போராட்டத்தில் தாக்கப்பட்ட காவல்துறை அதிகாரிகளின் குடும்ப உறுப்பினர்கள் தாக்கல் செய்த மனுவையும், மற்ற பட்டியலிடப்பட்ட மனுக்களுடன் சேர்த்து நாளை விசாரிப்பதாகத் தெரிவித்துள்ளது.

தலைமை நீதிபதி சூர்ய காந்த் பேசுகையில், ”அமைதியான முறையில் போராடும் உரிமை முழுமையாக உறுதி செய்யப்பட்டுள்ளது. அதனை மறுக்க முடியாது. அதேபோல, போராட்டம் நடைபெறுகிறது என்பதற்காக மட்டுமே காவல்துறையின் அத்துமீறல்களை நியாயப்படுத்த முடியாது.

இதற்கு ஒரு நடைமுறை இருக்கவேண்டும். முறையாக இடம் ஒதுக்கப்பட்டு, கட்டுப்பாடுகள் விதிக்கக்கூடாது. ஆனால், சமூக விரோத சக்திகள் இருந்தால் அதனைக் கையாளலாம். இது தில்லி பற்றியப் பிரச்னை மட்டுமல்ல. ஒழுங்கான நெறிமுறைகளைப் பின்பற்ற வேண்டும்” என்றார்.

காவல்துறையினர் தாக்கப்பட்டதாக வழக்கறிஞர் கூறியபோது, “யாராக இருந்தாலும் ஒவ்வொருவரின் உயிரும் முக்கியமானது” என்று நீதிபதி தெரிவித்தார். மேலும், மோதல் போக்கின்றி நீதிமன்றத்திற்கு உதவ வேண்டும் என்றும் மனுதாரர்களை நீதிபதி வலியுறுத்தினார்.

நீதிமன்றத்திற்கு பாரபட்சமற்ற முறையில் உதவுவதாக மத்திய அரசு சார்பில் ஆஜரான சொலிசிட்டர் ஜெனரல் துஷார் மேத்தா தெரிவித்தார்.

இதனைத் தொடர்ந்து, மனுக்கள் மீது நாளை விசாரணை நடைபெறும் என்று நீதிபதிகள் அமர்வு ஒப்புக்கொண்டது.
