The first session of the Tamil Nadu Legislative Assembly for this year began today (Jan. 20). Governor R.N. Ravi left without reading his speech. The DMK members expressed strong opposition to this. With the Governor leaving without reading his speech, Tamil Nadu Chief Minister M.K. Stalin took a stand and delivered the speech. Governor R.N. Ravi's action is unbecoming of his position... "Honorable Speaker, once again in the Tamil Nadu Legislative Assembly, the Honorable Governor has acted against the rules and traditions and has left the assembly; rather than just saying he left, he has actually walked out."
The actions of the Governor are not befitting the position he holds. According to Article 176 of the Indian Constitution, the Governor's address is to be fully read out by the Governor, prepared by the state government. The Constitution does not allow the Governor to express his own opinions or to delete parts of the address prepared and provided by the state government. Just as a goat does not need a beard, a state does not need a Governor's position. Article 176, which deals with the Governor's address in the Constitution, does not provide a way to seek clarifications. However, after the Governor made some such clarifications and wrote a letter to the government yesterday, a response was given to him accordingly.
In this situation, the honorable Governor has deliberately acted against the constitutional law. I believe the Governor's action is a disrespect to this people's assembly, which has a century-old tradition and long heritage, and to its authority. I would like to recall a part of the speech I delivered in the same assembly on 10-4-2023. "Neither a beard for a goat nor the position of Governor for a country is necessary. Even when the great scholar Anna said this, and when the great Tamil scholar leader Kalaignar advocated it, the Chief Ministers did not err in giving due respect to that position as long as it existed." We have a duty to follow the path laid by the veterans who have preserved the dignity of this assembly, which is celebrating its centenary, functioning with order and distinction, so that its glory does not fade.

இந்த ஆண்டின் முதல் தமிழ்நாடு சட்டசபைக் கூட்டத்தொடர் இன்று (ஜன.20) தொடங்கியது. ஆளுநர் ஆர்.என் ரவி உரையை வாசிக்காமலேயே அவையிலிருந்து புறப்பட்டுச் சென்றார். இதற்கு திமுகவினர் கடுப்பு எதிர்ப்பு தெரிவித்திருந்தனர்.
ஆளுநர் அவர்கள் உரையை வாசிக்காமல் அவையிலிருந்து வெளியேறிய நிலையில், தமிழக முதலமைச்சர் மு.க. ஸ்டாலின் தீர்மானத்தைக் கொண்டு வந்து உரை ஆற்றியிருக்கிறார்.
ஆளுநரின் செயல் பதவிக்கு அழகல்ல…
“மாண்புமிகு பேரவைத் தலைவர் அவர்களே, தமிழ்நாடு சட்டமன்றப் பேரவையில் மீண்டும் ஒரு முறை மாண்புமிகு ஆளுநர் அவர்கள் சட்ட விதிகளையும், மரபுகளையும் மீறி செயல்பட்டு அவையிலிருந்து வெளியே சென்றுள்ளார்; வெளியே என்று சொல்வதைவிட, வெளியேறிச் சென்றிருக்கிறார்.
ஆளுநரின் செயல் அவர் வகிக்கக்கூடிய பதவிக்கு அழகல்ல. இந்திய அரசமைப்புச் சட்டம் Article 176-ன்படி, ஆளுநர் உரை என்பது மாநில அரசால் தயாரிக்கப்பட்டு ஆளுநரால் முழுமையாகப் படிக்கப்பட வேண்டிய ஒன்றாகும். இதில் ஆளுநர் தனது சொந்த கருத்துக்களைத் தெரிவிப்பதற்கோ, மாநில அரசால் தயாரித்து வழங்கப்பட்ட உரையில் நீக்கம் செய்வதற்கோ அரசமைப்புச் சட்டத்தில் இடமில்லை.
ஆட்டுக்கு தாடியும், நாட்டுக்கு ஆளுநர் பதவியும் தேவையில்லை
அரசமைப்புச் சட்டத்தில் ஆளுநரின் உரை குறித்து தெரிவிக்கும் Article 176-ல், தெளிவுரைகளைக் கேட்பதற்கு வழிவகை செய்யப்படவில்லை. இருப்பினும் நாம் அவர் அவ்வாறு சில விளக்கங்களைக் குறிப்பிட்டு அரசுக்கு நேற்று கடிதம் எழுதியதைத் தொடர்ந்து அவருக்கு அதற்கான பதிலும் அளிக்கப்பட்டது.
இந்த நிலையில் மாண்புமிகு ஆளுநர் அவர்கள் வேண்டுமென்றே அரசமைப்புச் சட்டத்தை மீறிய ஒரு செயலைச் செய்துள்ளார்.
ஆளுநரின் செயல் என்பது நூற்றாண்டு கால மரபையும், நீண்ட பாரம்பர்யத்தையும் கொண்ட இந்த மக்கள் சபையை, அதன் மாட்சிமையை அவமதிக்கும் செயலாகும் என்றே நான் கருதுகிறேன்.
10-4-2023 அன்று இதே பேரவையில் நான் ஆற்றிய உரையின் ஒரு பகுதியை இங்கே நான் நினைவுகூர விரும்புகிறேன். “ஆட்டுக்கு தாடியும், நாட்டுக்கு ஆளுநர் பதவியும் தேவையில்லை. பேரறிஞர் அண்ணா அவர்கள் கூறியபோதிலும், அதை முத்தமிழறிஞர் தலைவர் கலைஞர் அவர்கள் வழிமொழிந்தபோதிலும், அந்தப் பதவி இருக்கும்வரை அதற்குரிய மரியாதையைக் கொடுக்க அவர்கள் முதலமைச்சர்களாக இருந்த நேரத்தில் தவறியதில்லை.
மிகவும் வருத்தத்திற்குரியது!
அவர்களது வழியைப் பின்பற்றி நானும் அதிலிருந்து இம்மியளவும் விலகியதில்லை; இந்த அரசும் தவறியதில்லை” என்று அன்றைக்கு நான் எடுத்துரைத்தேன். அந்தக் கொள்கையையொட்டியே நான் ஆளுநர் அவர்கள் உரை நிகழ்த்த வேண்டும் என்று நடவடிக்கை எடுக்க ஆணையிட்டேன்.
எனினும், மாண்புமிகு ஆளுநர் அவர்கள் ஏற்கெனவே நடந்துகொண்டது போலவே மீண்டும் இன்று செயல்பட்டிருப்பது மிகவும் வருத்தத்திற்குரியது. தமிழ்நாடு சட்டமன்றம், எட்டரைக் கோடி தமிழ் மக்களுடைய உணர்வுகளைப் பிரதிபலிக்கின்ற மாமன்றம். ஆளுநர் என்பவர் மாநில நலனில் அக்கறை கொண்டவராக, மக்கள் மேம்பாட்டில் ஆர்வம் கொண்டவராக, உண்மையைப் பேசுபவராக இருக்க வேண்டும்.
மக்களுடைய பேராதரவோடு, பெரும்பான்மையோடு வெற்றி பெற்று ஆட்சி அமைத்துள்ள அரசு எடுக்கின்ற முடிவுகளுக்கு ஒத்துழைப்பவராக இருக்க வேண்டும்.
அதைத்தான் அரசமைப்புச் சட்டமும் அந்தப் பதவி வகிப்பவரிடம் இருந்து எதிர்பார்க்கிறது. ஆனால் நம்முடைய ஆளுநர் அவர்கள் அதற்கு மாறாகச் செயல்படுகிறார். மாநில நிர்வாகத்தை முடக்கவும், பொது மேடைகளில் அரசியல் பேசியும் அவதூறு பரப்பிவருகிறார்.
அது அவரது சொந்த விருப்பம் என்று கருதலாம். எனினும், அத்தகைய ஒரு முயற்சியை இங்கும் செய்ய அவர் முனைவது ஏற்புடையதல்ல. நூற்றாண்டு விழா கொண்டாடி, சீரோடும், சிறப்போடும் இயங்குகின்ற இப்பேரவையின் புகழ் மங்கிடாத வகையில் பாதுகாத்து வந்த சான்றோர்களின் வழித்தடத்தினைப் பின்பற்ற வேண்டிய கடமை நமக்கு உள்ளது.
வரலாற்றுப் பெருமை கொண்ட இப்பேரவையின் மாண்பினைப் பாதுகாக்க வேண்டிய முதல் பொறுப்பு எனக்கு உள்ள காரணத்தால், கீழ்க்காணும் தீர்மானத்தை மாண்புமிகு பேரவைத் தலைவர் அவர்களின் இசைவோடு, சட்டமன்றப் பேரவை விதி 17-ஐத் தளர்த்தி, முன்மொழிந்திட அனுமதி கோருகிறேன். (பேரவைத் தலைவரால் அனுமதி வழங்கப்பட்டது.)
நிறைவேற்றப்பட்ட தீர்மானம்
ஏற்கெனவே உள்ள நடைமுறைகளைப் பின்பற்றி, தமிழ்நாடு அரசால் தயாரித்து அனுப்பி வைக்கப்பட்ட ஆளுநர் உரையை பேரவையில் படிக்காமல் மாண்புமிகு ஆளுநர் அவர்கள் சென்றுள்ளதை இப்பேரவை ஏற்கவில்லை. மாண்புமிகு ஆளுநர் அவர்களுக்கு அனுப்பி வைக்கப்பட்ட, சட்டமன்ற உறுப்பினர்களின் மேசையில் உள்ள கணினியில் பதிவேற்றம் செய்யப்பட்ட ஆளுநர் உரையின் ஆங்கில மொழியாக்கம் இங்கே மாண்புமிகு ஆளுநர் அவர்களால் படிக்கப்பட்டதாக இப்பேரவைக் கருதுகிறது. அவ்வாறே அவைக் குறிப்பில் நடவடிக்கைக் குறிப்புகள் இடம் பெறலாம்.
மேலும், மரபுவழி நிகழ்வுகள், மாண்புமிகு பேரவைத் தலைவர் அவர்களால் படிக்கப்பெறவுள்ள ஆளுநர் உரையின் தமிழாக்கம் மற்றும் நான் முன்மொழிகின்ற தீர்மானம், அதன் முடிவு ஆகியவை மட்டும் பேரவை நடவடிக்கைக் குறிப்பில் இடம் பெறலாம் என்னும் தீர்மானத்தை மொழிகிறேன். இந்தத் தீர்மானத்தை அனைத்து உறுப்பினர்களும் ஒருமனதாக நிறைவேற்றித் தர வேண்டுகிறேன்” என்று முதலமைச்சர் ஸ்டாலின் உரையாற்ற தீர்மானம் அவையில் ஒருமனதாக நிறைவேற்றப்பட்டது.
முரண்டு பிடிக்கும் ஆளுநர்
தொடர்ந்து பேசிய ஸ்டாலின், “மாண்புமிகு பேரவைத் தலைவர் அவர்களே, இந்தச் சட்டமன்றத்தின் மாண்பைக் காத்து, இந்தத் தீர்மானத்தை நிறைவேற்றித் தந்த மாண்புமிகு உறுப்பினர்கள் அனைவருக்கும் என்னுடைய நன்றியைத் தெரிவித்துக் கொள்கிறேன்.
ஆண்டுதோறும் அரசின் சார்பில் உரை தயாரித்து அனுப்புவதும், அதனை முறையாக வாசிக்காமல் ஆளுநர் அவர்கள் முரண்டு பிடிப்பதும் தொடர்ந்து வருவது நல்லதல்ல.
ஆளுநர்கள் மாநில அரசுகளுக்கு இடைஞ்சலாக இருந்து இப்படி செயல்படுவது இங்கு மட்டுமல்ல, பல்வேறு மாநிலங்களிலும் நடந்து வருகிறது. ஒரு நாள் செய்தியாக இதனைக் கடந்துவிட முடியாது. ஆண்டின் தொடக்கத்தில் அரசின் கொள்கை அறிக்கையை ஆளுநர் அவர்கள் முறையாக வாசிப்பது நடைமுறை.
அந்த நடைமுறையை ஒருவர் தொடர்ந்து மீறும்போது அதுபோன்ற விதிகளை எதற்காக வைத்திருக்க வேண்டுமென்ற கேள்வி சாதாரணமாகவே அனைவரின் மனதிலும் எழும்.
எனவே, ஆண்டின் தொடக்கத்தில் ஆளுநர் உரை என்ற நடைமுறையை விலக்கிடும் வகையில் அரசமைப்புச் சட்டத்தைத் திருத்துவதற்கான முயற்சிகளை இந்தியா முழுவதும் இருக்கும் ஒத்த கருத்துகளைக் கொண்ட அரசியல் கட்சிகள் துணையோடு இந்திய நாடாளுமன்றத்தில் திராவிட முன்னேற்றக் கழகம் முன்னெடுக்கும் என்ற உறுதியையும் இந்த மாமன்றத்தில் அறிவிக்கிறேன்” என்று தெரிவித்திருக்கிறார்.
