In the case concerning the imprisonment of private construction company owner Santhosh Sharma under the Goondas Act, the court has strongly criticized Arun IPS, the Director of the Vigilance and Anti-Corruption Department. The Madras High Court said that when Arun IPS was serving as the Chennai City Police Commissioner, he ordered that the Goondas Act be invoked against Santhosh Sharma, the owner of a private construction company, based on complaints of irregularities filed against him. Challenging this order, Santhosh Sharma’s daughter had filed a case in the Madras High Court. In this case, on last Wednesday, the court ordered Arun IPS to appear before it.The court representative who went to deliver the summons to Arun IPS’s office was made to wait for 2 hours. Expressing strong condemnation over this, the judge ordered that Arun IPS must remain in court until the assistant who made the court’s representative wait appears before the court. Following this, the case was finally taken up for hearing. Appearing before the judges, Arun argued, “In my 28 years of service, there has been no complaint against me. It is the criminals and anti-social elements who were subjected to action by me who are spreading defamation against me on social media.” Meanwhile,Yesterday, a bench comprising Judges G.R. Swaminathan and V. Letchumanan ordered the quashing of the Goondas Act case filed against Santhosh Sharma. The judges also strongly criticized Arun, IPS. “Arun knows very well that this case is not dangerous enough to warrant detention under the Goondas Act. He has filed the case based on incidents that happened two years ago. Arun is not a new officer.”An officer with 28 years of experience, having qualified directly as an IPS officer, doing this appears to be a deliberate act carried out knowingly despite being aware of the law. Arun IPS has made it a habit to invoke the Goondas Act in this manner. He has filed cases against people like Savukku Shankar and Varahi in the same way. Each time, the court has quashed those cases. The explanations given by Arun IPS are not acceptable. Arun, who was on the waiting list, is now the Director of the Anti-Corruption Department. This is an institution where officers of the highest integrity and reputation, such as C.V. Narasimhan and C.L. Ramakrishnan, have served.There were no charges against them throughout their entire service period. Corruption is a great evil against society. Just as Caesar’s wife must be beyond suspicion, the post of Director of the Anti-Corruption Department should also be held only by officers with a good reputation and integrity,” they said. The judges also ordered that if there were no other cases against Santhosh Sharma, he should be released immediately.

அருண் ஐ.பி.எஸ் சென்னை மாநகர காவல் ஆணையராக இருந்த போது தனியார் கட்டுமான நிறுவன உரிமையாளரான சந்தோஷ் சர்மா மீது கொடுக்கப்பட்ட முறைகேடு புகார்களின் அடிப்படையில் அவர் மீது குண்டர் சட்டத்தை பதிவு செய்ய உத்தரவிட்டார். இந்த உத்தரவை எதிர்த்து சந்தோஷ் சர்மாவின் மகள் சென்னை உயர் நீதிமன்றத்தில் வழக்கு தொடர்ந்திருந்தார்.
இந்த வழக்கில் கடந்த புதன் கிழமை அருண் ஐ.பி.எஸ் நீதிமன்றத்தில் ஆஜராகக் கோரி உத்தரவிட்டனர். அந்த சம்மனை அருண் ஐ.பி.எஸ் இன் அலுவலகத்துக்கு வழங்க சென்ற நீதிமன்ற பிரதிநிதியை 2 மணி நேரம் காக்க வைத்திருக்கின்றனர். இதற்கு கடும் கண்டனங்களை தெரிவித்த நீதிபதி, நீதிமன்றத்தின் பிரதிநிதியை காக்க வைத்த உதவியாளர் நீதிமன்றத்தில் ஆஜராகும் வரை அருண் ஐ.பி.எஸ் நீதிமன்றத்திலேயே காத்திருக்க வேண்டுமென்று உத்தரவிட்டார்.

இதைத் தொடர்ந்து கடைசியாக அந்த வழக்கு விசாரணைக்கு எடுத்துக் கொள்ளப்பட்டது. நீதிபதிகள் முன்பு ஆஜரான அருண், ’28 ஆண்டுகால சர்வீஸில் என் மீது எந்த புகாரும் இல்லை. என்னால் நடவடிக்கைக்கு உள்ளாக்கப்பட்ட குற்றவாளிகளும் சமூக விரோதிகளுமே சமூகவலைதளங்களின் என் மீது அவதூறு பரப்பி வருகின்றனர்’ என தன்னுடைய வாதத்தை முன்வைத்தார்.
இந்நிலையில், நேற்று நீதிபதிகள் ஜி.ஆர்.சுவாமிநாதன் மற்றும் வி.லெட்சுமிநாராயணன் அடங்கிய குழு சந்தோஷ் சர்மா மீது தாக்கல் செய்யப்பட்ட குண்டர் சட்டத்தை ரத்து செய்து உத்தரவிட்டிருக்கிறது. மேலும், அருண் ஐ.பி.எஸ் மீது கடும் கண்டனங்களையும் நீதிபதிகள் தெரிவித்தனர். ‘குண்டர் சட்டத்தை பயன்படுத்தி தடுப்புக் காவலில் வைக்கும் அளவுக்கு இந்த வழக்கு ஆபத்தானது இல்லை என்பது அருணுக்கு நன்றாகவே தெரியும். இரண்டு ஆண்டுகளுக்கு முன்பு நடந்த சம்பவங்களை மையமாகக் கொண்டு வழக்கை பதிந்திருக்கிறார். அருண் ஒன்றும் புதிய அதிகாரி அல்ல. நேரடி ஐ.பி.எஸ் ஆக தேர்ச்சிப் பெற்று 28 ஆண்டுகள் அனுபவமுள்ள ஒரு அதிகாரி இப்படி செய்வது சட்டத்தை அறிந்திருந்தும் வேண்டுமென்றே திட்டமிட்டு செய்த செயலாகவே தெரிகிறது.

அருண் இப்படி குண்டர் சட்டத்தை பிரயோகிப்பதை வழக்கமாக கொண்டிருக்கிறார். சவுக்கு சங்கர், வராகி போன்றோர் மீதும் இதே விதத்தில் வழக்கு பதிவு செய்திருக்கிறார். ஒவ்வொரு சமயத்திலும் நீதிமன்றம் அந்த வழக்குகளை ரத்து செய்திருக்கிறது. அருண் ஐ.பி.எஸ் கொடுக்கும் விளக்கங்கள் ஏற்புடையதாக இல்லை. காத்திருப்புப் பட்டியலில் இருந்த அருண் இப்போது லஞ்ச ஒழிப்புத்துறையின் இயக்குனர். சி.வி.நரசிம்மன், சி.எல்.ராமகிருஷ்ணன் போன்ற உயர்ந்த நேர்மையும் நற்பெயரும் கொண்ட அதிகாரிகள் பணியாற்றிய இது. அவர்கள் மீது பணிக்காலம் முழுவதும் எந்தக் குற்றச்சாட்டும் இருந்தது இல்லை. ஊழல் சமூகத்துக்கு எதிரான பெரும் தீமை. சீசரின் மனைவி சந்தேகத்திற்கு அப்பாற்பட்டவராக இருக்க வேண்டும் என்பதைப் போல லஞ்ச ஒழிப்புத்துறையிம் இயக்குனர் பதவியிலும் நற்பெயரும் நேர்மையும் கொண்ட அதிகாரிகளே இருக்க வேண்டும்’ என்றனர்.
சந்தோஷ் சர்மா மீது வேறு எந்த வழக்குகளும் இல்லாதபட்சத்தில் அவரை உடனடியாக விடுதலை செய்ய வேண்டும் என்றும் நீதிபதிகள் உத்தரவிட்டனர்.
