The honor killing of IT engineer Kavin in Nellai last year caused a stir across Tamil Nadu. In this case, a case was registered against Surjith, the brother of the woman Kavin loved, his father Saravanan, mother Krishnakumari, and relative Jayapal.
While the other three were arrested, Krishnakumari had been absconding for the past 10 months. In this situation, she too was arrested by the police only two weeks ago. This case is being heard by the Nellai District Prevention of Atrocities Act court.
In this situation, Assistant Inspector of Police Saravanan, who was arrested and is in prison, had filed a petition in the Nellai District Scheduled Castes and Scheduled Tribes Prevention of Atrocities Act court seeking bail. This petition was dismissed.
He then filed a petition in the Madurai Bench of the Madurai High Court, seeking to set aside the order of the Atrocities Prevention Act court that had denied him bail and to grant him bail. This case came up for hearing yesterday before Judge Pugazhendhi.
On behalf of the CBI-CID, the lawyer appearing for the side objected, saying, “Saravanan should not be granted bail. If bail is granted, it will affect the investigation of the case.”
Advocate Anand, appearing for Saravanan, said, “We will fully cooperate with the case; we will not tamper with evidence; we are ready to abide by the conditions imposed by the court.”
Following this, in the judgment delivered by the judge, it was stated: ‘The petitioner shall not make any attempt to meet or tamper with the evidence in this case. The petitioner shall stay in Coimbatore until further orders and must sign daily at the police station. A bail bond worth one lakh must be furnished,’ among various other conditions, and the judge ordered bail for the petitioner.

இந்நிலையில் கைது செய்யப்பட்டு சிறையில் உள்ள காவல் உதவி ஆய்வாளர் சரவணன், நெல்லை மாவட்ட வன்கொடுமை தடுப்புச் சட்ட நீதிமன்றத்தில் ஜாமீன் வழங்க கோரி மனு தாக்கல் செய்திருந்தார். இந்த மனு தள்ளுபடி செய்யப்பட்டது.
இந்நிலையில் தனக்கு ஜாமீன் வழங்க மறுத்த வன்கொடுமை தடுப்புச் சட்ட நீதிமன்றத்தின் தீர்ப்பை ரத்து செய்து தனக்கு ஜாமீன் வழங்க வேண்டும் என மதுரை உயர் நீ்திமன்ற மதுரை கிளையில் மனு தாக்கல் செய்தார். இந்த வழக்கு நேற்று நீதிபதி புகழேந்தி முன் விசாரணைக்கு வந்தது.
சி.பி.சி.ஐ.டி தரப்பில் ஆஜரான வழக்கறிஞர் தரப்பில், ’சரவணனுக்கு ஜாமீன் வழங்கக் கூடாது. அப்படி வழங்கினால் வழக்கின் விசாரணை பாதிக்கும்’ என ஆட்சேபனை தெரிவித்தார்.
சரவணன் தரப்பில் ஆஜரான வழக்கறிஞர் ஆனந்த், “வழக்குக்கு முழு ஒத்துழைப்பு வழங்கப்படும் சாட்சியங்களை கலைக்க மாட்டோம்; நீதிமன்றம் விதிக்கும் நிபந்தனைகளுக்கு கட்டுப்பட தயாராக இருக்கிறோம்” தெரிவித்தார்.
இதனைத் தொடர்ந்து நீதிபதி வழங்கிய தீர்ப்பில், ‘மனுதாரர் இந்த வழக்கின் சாட்சியங்களை சந்திக்கவும் கலைப்பதற்கான முயற்சியோ செய்யக்கூடாது. மனுதாரர் மறு உத்தரவு வரும் வரை கோயம்புத்தூரில் தங்கி காவல் நிலையத்தில் தினசரி கையெழுத்து இடவேண்டும். ஒரு லட்சம் மதிப்பில் பிணை பத்திரம் வழங்க வேண்டும்” உள்ளிட்ட பல்வேறு நிபந்தனைகளை வழங்கி மனுதாரருக்கு ஜாமீன் வழங்கி நீதிபதி உத்தரவு பிறப்பித்தார்.
