New Delhi: The Supreme Court has ruled that the use of the internet is a fundamental right of children under the age of 18.
A case was filed in the Supreme Court on behalf of the Delhi-based voluntary organization Just Rights for Children Alliance. It stated, “Restrictions should be imposed on children under the age of 18 using social media. They may be allowed to access social media under parental supervision. The Supreme Court should issue appropriate orders in this regard.”
In this case, detailed arguments were presented on behalf of the voluntary organization and the Central Government. After hearing the arguments of all parties, the Supreme Court bench of Justices J.B. Pardiwala and K. Vinod Chandran delivered its verdict yesterday. It stated: Under Article 21 of the Indian Constitution, every individual has the right to use the internet. This is a fundamental right. Children also have this right.
All children, regardless of age, can use the internet. This is their fundamental right. Children’s right to the internet cannot be denied on the grounds of the dangers that arise online. In this matter, the Supreme Court delivered an important judgment in 2024. Social media platforms have not properly followed this.
In this regard, the Central Government should take appropriate action. The Central Government should take steps to remove from websites the photographs and videos related to child sexual abuse. Strict fines and punishments should be imposed on those involved. Our children must be protected. At the same time, their rights must also be ensured. This is what the judgment states.
