கட்சி மதிமுக-தான், ஆனா சின்னம் உதயசூரியன்!
தென்காசி மாவட்டம், வாசுதேவநல்லூர் தொகுதி எம்.எல்.ஏ சதன் திருமலைக்குமாருக்கு காசோலை மோசடி வழக்கில் இரண்டு ஆண்டுகள் சிறைத் தண்டனை விதிக்கப்பட்டுள்ளதால், அவரது பதவி பறிபோகுமா என்கிற கேள்வி எழுந்துள்ளது.
சென்னையில் நிதி நிறுவனம் ஒன்றில் வாங்கிய கடனுக்காக இவர் தந்த காசோலைகள் பவுன்ஸ் ஆகி விட்டதையடுத்து, அவருக்கு இந்த தண்டனை கிடைத்துள்ளது.
அதேநேரம் தண்டனையை மேல்முறையீடு செய்ய கால அவகாசம் தரப்பட்டிருப்பதால், அதுவரை தண்டனை நிறுத்தி வைக்கப்படுவதாகவும் அறிவிக்கப்பட்டுள்ளது.

மக்கள் பிரதிநிதித்துவச் சட்டம் 1951 பிரிவு 8 (3)ன் படி எம்.எல்.ஏ மற்றும் எம்.பி-க்கள் இரண்டாண்டோ அல்லது அதற்கு மேலோ சிறைத் தண்டனை பெற்றால் உடனடியாக அவர்களது பதவி காலியாகி விடும்.
மேல்முறையீட்டுக்குச் சென்றால் தண்டனை முழுவதுமாக ரத்து செய்யப்பட்டால் மட்டுமே திரும்பவும் அந்தப் பதவி கிடைக்கும்.
இதே சட்டப் பிரிவு 8 (1) ல் எந்தெந்த வகையான குற்றங்கள் என்பவையும் பட்டியலிடப் பட்டுள்ளன.
தண்டனை தந்ததும் இப்ப பதவி தந்ததும் ஒரே ஆள்!
தமிழ்நாட்டில் முதன் முதலாக இந்தச் சட்டத்தின் படி பதவியை இழந்தவர் செல்வகணபதி. சுடுகாட்டுக் கொட்டகை ஊழல் வழக்கில் இவருக்கு தண்டனை கிடைத்தது.
வேடிக்கை என்னவென்றால் இவர் ஊழல் செய்தார் என வழக்கு போட்டது திமுக. ஆனால் இவருக்குத் தண்டனை கிடைத்த போது அதிமுக-வில் இருந்து விலகி திமுக-வில் இருந்தார். பிறகு அந்த தண்டனை மேல் முறையீட்டில் ரத்து செய்யப்பட தற்போது அதே திமுக-வின் சார்பாக மக்களவை உறுப்பினராக இருக்கிறார்.
தொடரலாமா கூடாதா?
இந்தச் சட்டத்தின் படி பதவி இழந்த திமுக-வின் இரண்டாவது ஆள் பொன்முடி. வருமானத்துக்கு அதிகமாக சொத்து சேர்த்ததாகத் தொடரப்பட்ட வழக்கில் மூன்றாண்டு தண்டனை கிடைக்க, பதவி இழந்தார். ஆனால் மேல்முறையீட்டில் அந்த தண்டனைக்கு தடை விதிக்கப்பட்டது. அதாவது தண்டனை நிறுத்தி வைக்கப்படுவதாக அறிவிக்கப்பட்டது.
இந்தச் சட்டப்படி தண்டனை ரத்து செய்யப்பட்டால் மட்டுமே மீண்டும் பதவி கிடைக்கும் எனச் சொல்லப்பட்ட நிலையில் பொன்முடி விவகாரத்தில் தண்டனை ரத்து செய்யப்பட்டதாக தெரியவில்லை. இருந்தாலும் தற்போது திருக்கோவிலுர் எம்.எல்.ஏ.வாகத் தொடர்கிறார்.

அதிமுகவை எடுத்துக் கொண்டால், அதன் பொதுச் செயலாளர் ஜெயலலிதாவே இந்தச் சட்டத்தின் கீழ் பதவியை இழந்தார். மேல் முறையீட்டுக்குச் சென்று தீர்ப்பை ரத்து செய்து மீண்டும் பதவி வகித்தார். எதிர் தரப்பில் உச்ச நீதிமன்றம் சென்ற நிலையில், அதன் தீர்ப்பு வருவதற்குள் அவர் மறைந்து விட்டார்.
அதிமுகவில் எல்.எல்.ஏ.வாக இருந்த பாலகிருஷ்ண ரெட்டியும் இதே போல் பதவி இழந்தவர்தான்.. திமுக அரசைக் கண்டிதது அதிமுக நடத்திய ஒரு போராட்டத்தின் போது கல்வீச்சில் ஈடுபட்டு பொதுச் சொத்துக்கு சேதம் விளைவித்தார் என்பதுதான் இவர் மீதான குற்றச்சாட்டு. வழக்கில இவருக்கு மூன்றாண்டு தண்டனை கிடைக்க பதவி இழந்தார். பல வருடம் கழித்து கடந்தாண்டு இந்த தண்டனை ரத்து செய்யப்பட்டது.
இதே சட்டத்தின் கீழ் மோடியை அவதூறு செய்ததாக தொடரப்பட்ட வழக்கில்தால் காங்கிரஸ் கட்சியின் ராகுல் காந்தியும் பதவி இழந்தார். ஆனால் அவர் வழக்கை நடத்தி தண்டனை ரத்தாகி விட்டது.
ராகுல் காந்தி வெறும் அவதூறு குற்றச்சாட்டிலேயே பதவி இழந்ததைச் சுட்டிக்காட்டும் சட்ட நிபுணர்கள் சிலர், சதன் திருமலைக்குமார் மோசடி வழக்கு என்பதால் அவரது பதவி உடனடியாகக் காலியாகி விட்டது என்றுதான் அர்த்தம். அறிவித்து தெளிவுபடுத்த வேண்டியது சட்டப் பேரவைச் செயலகம்தான் என்கின்றனர்.
