இதுகுறித்து விசாரித்தபோது, ‘சென்னை உயர் நீதிமன்றத்தில் மூன்றாவது இடத்தில் பொறுப்பு வகித்து வந்த நீதிபதி ஜெ.நிஷாபானுவை, நிர்வாக காரணங்களுக்காக உச்ச நீதிமன்ற கொலிஜியம், கேரள உயர் நீதிமன்றத்திற்கு இடமாறுதல் செய்ய கடந்த ஆக்ஸ்ட் மாதம் மத்திய அரசுக்கும், குடியரசு தலைவருக்கும் பரிந்துரை செய்தது. அதை ஏற்றுக்கொண்ட குடியரசு தலைவர் திரௌபதி முர்மு, நீதிபதி ஜெ.நிஷா பானுவை கேரளாவுக்கு இடுமாறுதல் செய்து கடந்த அக்டோபர் 13 ஆம் தேதி உத்தரவிட்டார். ஆனால், நீதிபதி ஜெ.நிஷாபானுவோ, அக்டோபர் 14 ஆம் தேதியிலிருந்து நீண்ட மருத்துவ விடுப்பில் சென்றுள்ளார்.
இந்த நிலையில் இடமாறுதல் செய்யப்பட்ட கேரள உயர் நீதிமன்றத்தில் பொறுப்பேற்காமல் காலம் தாழ்த்துவது உச்ச நீதிமன்ற கொலீஜியம், நீதித்துறையின் மாண்பை அவமதிக்கும் செயல் என சென்னை உயர் நீதிமன்ற வழக்கறிஞர்களில் ஒரு தரப்பினர் குடியரசு தலைவருக்கு கடிதம் அனுப்பியுள்ளனர். இன்னொருபுறம், ‘சென்னை உயர் நீதிமன்றத்தில் 3 வது இடத்தில் இருக்கும் நீதிபதி ஜெ.நிஷாபானுவை வேண்டுமென்றே கேரள உயர் நீதிமன்றத்துக்கு இடமாறுதல் செய்து அவரை 9 வது இடத்திற்கு கொண்டு வந்துள்ளனர்’ என்று உயர் நீதிமன்ற வழக்கறிஞர்களின் மற்றொரு தரப்பினர் இடமாற்றத்துக்கு எதிர்ப்பும் தெரிவித்து வருகின்றனர்.
இதற்கிடையே காலியாக உள்ள நீதிபதிகள் பணியிடங்களை நிரப்ப சென்னை உயர் நீதிமன்றம் அனுப்பிய பரிந்துரைகளை தமிழக அரசு ஏற்க மறுத்து திருப்பி அனுப்பியதாகவும் சொல்லப்படுகிறது.
இந்த விவகாரம் பரபரப்பாக சென்று கொண்டிருந்த நிலையில்தான், உச்ச நீதிமன்ற தலைமை நீதிபதியுடன் ஆலோசனை நடத்திய குடியரசு தலைவர் பிறப்பித்துள்ள உத்தரவில், “சென்னை உயர் நீதிமன்றத்திலிருந்து கேரள உயர் நீதிமன்றத்துக்கு இடமாற்றம் செய்யப்பட்ட ஜெ.நிஷாபானு, டிசம்பர் 20 ஆம் தேதிக்குள் கேரள உயர் நீதிமன்றத்தில் பதவியேற்க வேண்டும்” என்ற குறிப்பிட்டுள்ளார்.
