Chennai: The Madras High Court has dismissed a petition seeking an order for a CBI investigation into the alleged horse-trading that took place in connection with the resignation of four AIADMK MLAs.
In a petition filed in the Madras High Court, Ramkumar Adithyan from Tiruchendur stated that on May 13, during the confidence vote, a letter was submitted on behalf of the AIADMK to the Speaker seeking the disqualification of 25 AIADMK MLAs who voted in support of the TVK government under the anti-defection law.
While it was pending, Maragatham Kumaravel (Madurantakam), Jayakumar (Perundurai), and Sathiyabama (Tharapuram), who voted in support of TVK on May 25, and Isakki Subbiah (Ambasamudram) on May 26, resigned from their posts and joined TVK.
Since 4 MLAs have joined TVK for political gain, horse-trading has taken place in this matter. Therefore, a CBI investigation should be ordered into this. The 4 who switched parties should be barred from contesting elections for a specified period,’ he had said.
This case came up for hearing before Chief Justice S.A. Dharmadhikari and Justice G. Arulmurugan. In the order issued after hearing the petition, the judges stated: This case has been filed merely on conjecture and suspicion, without any evidence. A CBI investigation cannot be ordered based on the petitioner’s belief that horse-trading has taken place.
Only if evidence is established that there was a prima facie case of wrongdoing can a CBI investigation be ordered. Since 4 MLAs suddenly resigned and switched parties, this cannot be described as criminal misconduct under the anti-corruption law. Therefore, the petition seeking a CBI investigation is dismissed.
