“Public interest litigations cannot be downgraded into a forum for the public to raise questions about projects without pointing out violations of law,” observed the Madras High Court, and dismissed a petition seeking a ban on the construction of the new bus stand in Kallakurichi.
In a public interest petition filed in the Madras High Court by A. Viswanathan of Alwarpet, Chennai, it was stated that construction work for a new bus stand is under way in Tirukovilur in Kallakurichi district, near the Ulagalandha Perumal Temple.
Since the old bus stand is functioning 400 meters away from the area where construction work is taking place, building a new bus stand is an unnecessary expense for the government. Constructing a bus stand near an ancient temple of archaeological importance is against the law protecting sites of archaeological importance.
Although complaint petitions regarding this were sent in February and May last year, they were not considered. Therefore, he had said that a ban should be imposed on building the new bus stand.
This case came up for hearing before a bench comprising Chief Justice S.A. Dharmadhikari and Justice G. Arulmurugan. The judges who heard the case said that, without proving any fundamental violations of law, this public interest litigation filed merely on the basis of photographs cannot be accepted to stall development works.
Public interest litigation cannot be reduced to a platform for the public to raise questions about projects without pointing out violations of law. The best judges to decide where a bus stand should be located are the officials.
It is for the authorities to assess factors such as urban growth and traffic congestion. Stating that courts cannot intervene in such matters in the absence of proof of illegality or violations, they dismissed the case and issued an order.
