English DMK alliance party MPs have submitted a resolution to the Lok Sabha Speaker seeking the removal of Chennai High Court Madurai Bench Judge G.R. Swaminathan. Judge G.R. Swaminathan had ordered that the Karthigai lamp be lit on the Thirupparankundram Malai Deepa Thoon. This order had caused a major controversy. Due to this, the DMK had planned to bring a resolution to remove Judge Swaminathan from his position. Accordingly, today (Dec 9), MPs from the DMK alliance parties have jointly submitted a petition to Lok Sabha Speaker Om Birla demanding the removal of Judge G.R. Swaminathan. 120 MPs have signed a resolution supporting the removal of Justice G.R. Swaminathan from office. To remove a High Court judge from office, at least 100 members of the Lok Sabha or 50 members of the Rajya Sabha must sign. Once this minimum support is reached and the resolution is accepted, it attains the status of a formal inquiry. After the petition is submitted by the MPs, a three-member committee is appointed, and once the report is submitted, the matter is allowed to be debated in Parliament. A vote will be conducted at the conclusion of the debate. It is noteworthy that the President will issue an order to remove the concerned judge from office only if two-thirds of the members vote in favor based on the related resolution. அதன்படி இன்று (டிச.9) திமுக கூட்டணிக் கட்சிகளின் எம்பிக்கள் ஒன்றாக இணைந்து நீதிபதி ஜி.ஆர் சுவாமிநாதனை பதவி நீக்கம் செய்ய வேண்டும் என்று மக்களவை சபாநாயகர் ஓம் பிர்லாவிடம் மனு அளித்துள்ளனர்.
நீதிபதி ஜி.ஆர்.சுவாமிநாதனை பதவி நீக்கக் கோரும் தீர்மானத்துக்கு ஆதரவாக 120 எம்.பி.க்கள் கையெழுத்திட்டுள்ளனர்.
ஒரு உயர் நீதிமன்ற நீதிபதியை பதவி நீக்கம் செய்ய வேண்டுமென்றால் மக்களவையிலிருந்து குறைந்தபட்சம் 100 உறுப்பினர்கள் அல்லது மாநிலங்களவையில் 50 உறுப்பினர்கள் கையொப்பமிட வேண்டும்.
இந்தக் குறைந்தபட்ச ஆதரவு எட்டப்பட்டு, தீர்மானம் ஏற்றுக்கொள்ளப்பட்டதும், அது முறையான விசாரணை நிலையை அடையும்.
அதன் பிறகு மூவர் குழு நியமிக்கப்பட்டு, அறிக்கை அளித்தவுடன் நாடாளுமன்றத்தில் பதவி நீக்கம் தொடர்பாக விவாதிக்க அனுமதிக்கப்படும். அதன் முடிவில் வாக்கெடுப்பு நடத்தப்படும்.
அதில் மூன்றில் இரண்டு பங்கு உறுப்பினர்கள் ஆதரவாக வாக்களித்தால்தான் அதுதொடர்புடைய தீர்மானத்தின் அடிப்படையில் சம்பந்தப்பட்ட நீதிபதியை பதவி நீக்கம் செய்ய குடியரசுத் தலைவர் உத்தரவு பிறப்பிப்பார் என்பது குறிப்பிடத்தக்கது.
