K.K. Ramesh from Madurai filed a public interest litigation in the Madurai Bench of the High Court, stating that officials denied permission to Hindus to light lamps and conduct worship at the summit of Thiruparankundram Hill, while allowing Muslims to go up the hill and worship on the day of Ramadan. இந்த வழக்கு நீதிபதி சதீஷ்குமார், ஜோதி ராமன் அமர்வு முன் விசாரணைக்கு வந்தது. அப்போது பேசிய நீதிபதிகள், ” திருப்பரங்குன்றத்தைத் தவிர வேறு பிரச்னையே இல்லையா திருப்பரங்குன்றம் தீப விவகாரம் குறித்து எத்தனை மனுக்கள் தான் தாக்கல் செய்வீர்கள் நீதிமன்றத்திற்கு வேறு ஏதும் வேலை இல்லையா?. இந்த மனு விசாரணைக்கு எடுத்துக் கொள்ள வேண்டுமென்றால் மனுதாரர் 10 லட்ச ரூபாய் கோவில் நிதிக்கு வைப்புத்தொகை வைத்தால் இந்த மனுக்களை விசாரணைக்கு எடுத்துக் கொள்கிறோம்” என தெரிவித்தனர்.
அப்போது மத்திய அரசின் வழக்கறிஞர் கோவிந்தராஜன் ஆஜராகி “மனுதாரர் இதே வேலையாக தான் இருக்கிறார். இதனால் அரசுக்கு மிகப்பெரிய இழப்பு ஏற்படுகிறது. மாநில அரசு வழக்கறிஞர்களுக்கான கட்டணம் மத்திய அரசின் வழக்கறிஞர்கான கட்டணம் என பல லட்ச ரூபாய் மனுதாரரின் மனுக்காக செலவிடப்படுகிறது. எனவே இதை சாதாரணமாக தள்ளுபடி செய்தால் மீண்டும் மீண்டும் மனுதாரர் இதேபோன்று மனுக்களை தான் தாக்கல் செய்வார். இவருக்கு அதிகபட்ச அபராதம் விதித்து மனுக்களை தள்ளுபடி செய்ய வேண்டுமென” வாதிட்டார்.
தமிழ்நாடு அரசு தரப்பில் ஆஜரான கூடுதல் தலைமை வழக்கறிஞர் ரவீந்திரன், `மனுதாரருக்கு இதே வேலை தான். ஏற்கெனவே இது போன்ற மனுக்கள் தாக்கல் செய்யப்பட்டு தள்ளுபடி செய்யப்பட்டுள்ளது. எனவே மனுதாரருக்கு அதிகபட்சமாக அபராதங்கள் விதித்து மனுவை தள்ளுபடி செய்ய வேண்டும்’+என வாதிட்டார்.
இதனைத் தொடர்ந்து நீதிபதிகள் மனுவை தள்ளுபடி செய்தது மட்டுமல்லாமல் 5 லட்ச ரூபாய் அபராதம் விதிப்பதாக தெரிவித்தனர்.
அப்போது மனுதாரர் தரப்பில் ஆஜரான வழக்கறிஞர் ‘அபராத தொகை எங்களால் கட்ட முடியாது எனவே இனி இது போன்ற மனுக்களை தாக்கல் செய்ய மாட்டோம் அபராதம் விதிக்க வேண்டாம்’ என வேண்டுகோள் வைத்தார். இதற்கு தமிழக அரசு மற்றும் மத்திய அரசு வழக்கறிஞர்கள் ஆட்சேபனை தெரிவித்தனர்.
இதனைத் தொடர்ந்து நீதிபதிகள் ஐம்பதாயிரம் ரூபாய் அபராதம் விதிப்பதாக தெரிவித்தனர். இதற்கும் மனுதாரர் தரப்பு வழக்கறிஞர், “இந்தத் தொகையும் மனுதாரரால் கட்ட முடியாது எனவே நீதிமன்றம் தங்களுக்கு கருணை காட்ட வேண்டும் வழக்கை திரும்பப் பெற்றுக் கொள்கிறோம்” என வேண்டுகோள் வைத்தார்.
அப்போது நீதிபதிகள், ‘மனுதாரர் ஊடகங்களில் தனது பெயர் வர வேண்டும் என்ற நோக்கில் இதுபோன்று மனுக்களை தொடர்ந்து தாக்கல் செய்வதாக தெரிய வருகிறது. எனவே இதுபோன்ற தேவையற்ற மனுக்களை இனி பொதுநல வழக்காக தாக்கல் செய்ய மாட்டேன் என நீதிமன்றத்தில் உறுதிமொழி பத்திரம் வழங்கும் பட்சத்தில் மனுதாரருக்கு விதிக்கப்பட்ட அபராதத்தை திரும்ப பெறுவது குறித்து பரிசீலிக்கப்படும்” என கூறி மனுவை தள்ளுபடி செய்து உத்தரவு பிறப்பித்தனர்.
இதற்கு முன்னதாக திருப்பரங்குன்றம் விவகாரம் தொடர்பான நீதிமன்ற அவமதிப்பு அனைத்து வழக்குகளையும் தனி நீதிபதி ஜி.ஆர் சுவாமிநாதன் விசாரணை செய்ய தடை விதித்தோடு, நீதிமன்றத்தை அரசியல் மேடையாக மாற்ற வேண்டாம் எனவும் இரு நீதிபதிகள் கொண்ட உயர் நீதிமன்ற மதுரை கிளை அமர்வில் உத்தரவு பிறப்பிக்கப்பட்டிருந்தது குறிப்பிடத்தக்கது.
