இந்தநிலையில், டாக்டர் ராமதாஸ் புதிதாக மேலும் 2 வழக்குகளை தாக்கல் செய்துள்ளார். அதில் ஒரு வழக்கில், ‘‘பா.ம.க., தலைவராக நான்தான் உள்ளேன். இதுதொடர்பான வழக்கு டெல்லி ஐகோர்ட்டில் விசாரிக்கப்பட்டபோது, உட்கட்சி தேர்தல் நடத்தி தலைவராக தேர்ந்தெடுத்து பரிந்துரை கடிதத்தை அனுப்பி வைத்தால், அதை பதிவு செய்து அங்கீகரிப்போம் என்று தேர்தல் ஆணையம் கூறியது. அதன்படி தலைவராக பதிவு செய்யும்படி நான் அனுப்பிய கடிதத்தை இதுவரை தேர்தல் ஆணையம் பரிசீலிக்காமல் உள்ளது. தற்போது தமிழ்நாடு சட்டசபைக்கு தேர்தல் நெருங்குவதால் எந்நேரமும் தேர்தல் அறிவிப்பு வெளிவரலாம் என்ற நிலை உள்ளது. அதனால், என்னை பா.ம.க., தலைவராக அங்கீகரித்து பதிவு செய்யும்வரை, தமிழ்நாடு சட்டசபைக்கு தேர்தல் அறிவிப்பை வெளியிடக்கூடாது என்று தேர்தல் ஆணையத்துக்கு உத்தரவிடவேண்டும்’’ என்று கூறியுள்ளார்.
மாம்பழம் சின்னம் எனக்கு தான் சொந்தம்
மற்றொரு மனுவில், ‘‘பா.ம.க.வின் தேர்தல் சின்னமாக மாம்பழம் உள்ளது. ஆனால், கட்சிக்கு சம்மந்தமே இல்லாத சிலர் இந்த சின்னத்தை பயன்படுத்துகின்றனர். எனவே, இந்த சின்னத்தை வேறு யாரும் பயன்படுத்த கூடாது என்றும் இந்த மாம்பழம் சின்னம் எனக்கும், நான் தலைவராக இருக்கும் பா.ம.க.விற்கு மட்டுமே சொந்தம் என்று அறிவிக்கவேண்டும்’’ என்று கூறியுள்ளார். இந்த 2 வழக்குகளும் தலைமை நீதிபதி எம்.எம்.ஸ்ரீவத்சவா, நீதிபதி ஜி.அருள் முருகன் ஆகியோர் முன்பு இன்று விசாரணைக்கு வந்த்து.
இந்த வழக்கை விசாரித்த நீதிபதிகள், ” இந்த இரண்டு வழக்குகளையும் தள்ளுபடி செய்கிறோம். இந்த வழக்குகள் விசாரணைக்கு உகந்ததல்ல.
ஒரு அரசியல் கட்சியின் உள் விவகாரம் குறித்து சிவில் கோர்ட்டை அணுகிதான் நிவாரணம் பெறவேண்டும்.
சிவில் கோர்ட்டின் உத்தரவின் படி, தேர்தல் ஆணையத்தை அணுகலாம். இந்த விவகாரத்தில் தந்தை மகனுக்கு மத்தியில் பிரச்சனை உள்ளது. ஏன் தந்தையின் பேச்சை மகன் கேட்பதில்லையா?” என்று கேள்வி கேட்டனர். அதற்கு ராமதாஸ் தரப்பில் தந்தையின் பேச்சை மகன் கேட்பது இல்லை என்று பதிலளிக்கப்பட்டது.
தேர்தல் ஆணையத்தின் சார்பில் ஆஜரான வக்கீல், `பாமக அங்கீகரிக்கப்படாத பதிவு செய்யப்பட்ட அரசியல் கட்சியாகும். எனவே இதில் ஹை கோர்ட் தலையிட முடியாது. அதேபோல ராமதாஸுக்கு மாம்பழம் சின்னத்தை ஒதுக்கிவிட்டு பிறருக்கு வழங்காமல் முடக்கி வைக்கவும் முடியாது’ என்று கூறினார்.
