We often see a Member of the Legislative Assembly (MLA) contesting in the parliamentary elections, and similarly, a Member of Parliament (MP) contesting in the legislative assembly elections. Can a person who is an MP contest in the MLA elections while still being an MP? Likewise, can a person hold two positions simultaneously? What does the law say? According to the Indian constitutional law, there is no restriction on a Member of Parliament contesting in the legislative assembly elections. However, the law states that after winning, the person cannot hold both positions at the same time. What does the Parliament Act say? According to the Representation of the People Act, 1951—
If a person is an MP and is elected as an MLA, they must resign from one of the positions within 14 days. If they fail to do so, they will automatically lose their parliamentary membership. According to Article 101(2) of the Indian Constitution, a person cannot be a member of both Parliament and a State Legislative Assembly at the same time. An MP contesting for the MLA position is not required to resign from their MP post before contesting. However, after winning, they must definitely resign from their MP position.
Who are the ones who contested in the MLA elections after being MPs? There are some who have contested in the MLA elections after serving as MPs in politics. For instance, in 1954, Kamaraj, who was the Member of Parliament for Srivilliputhur, contested and won the by-election for the Gudiyatham assembly constituency and became an MLA. Similarly, Prime Minister Modi was the Chief Minister of Gujarat when he became the MP for the Varanasi constituency in 2014. After that, he resigned from his Chief Minister post. Additionally, Edappadi K. Palaniswami contested as the Chief Minister candidate in Karnataka in 2018 while still being a Lok Sabha MP. Later, he resigned from his MP position.
Anbumani, who was an MP from Dharmapuri, contested as the Chief Ministerial candidate of the PMK in the Pennagaram constituency in the 2016 Assembly elections. Although he faced defeat in that election, he did not resign from his MP position and continued in the same role. Thus, even if someone is an MP in the Parliament, they can contest in the Assembly elections. Similarly, even if someone is a Chief Minister or MLA in the Assembly, they can contest in the Parliament elections. However, it is noteworthy that one cannot hold both positions simultaneously.

இந்திய அரசியலமைப்புச் சட்டத்தின்படி, ஒரு நாடாளுமன்ற உறுப்பினர், சட்டமன்றத் தேர்தலில் போட்டியிடுவதற்குத் தடை ஏதுமில்லை. ஆனால், அவர் வெற்றி பெற்ற பிறகு இரண்டு பதவிகளிலும் ஒரே நேரத்தில் நீடிக்க முடியாது என்று தான் சட்டம் சொல்கிறது.
சட்டம் என்ன சொல்கிறது?

எம்.பி-யாக இருப்பவர் எம்.எல்.ஏ பதவிக்கு போட்டியிடும் போது தனது பதவியை ராஜினாமா செய்ய வேண்டிய அவசியம் இல்லை. ஆனால் வெற்றி பெற்ற பின்னர் தனது எம்.பி பதவியை நிச்சயம் ராஜினாமா செய்ய வேண்டும்.
எம்.பி-க்களாக இருந்து எம்.எல்.ஏ தேர்தலில் போட்டியிட்டவர்கள் யார் யார்?
அரசியலில் எம்.பி-க்களாக இருந்து எம்.எல்.ஏ தேர்தலில் போட்டியிட்டவர்கள் சிலர் இருக்கின்றனர்.
அந்தவகையில் 1954-ல் ஸ்ரீவில்லிபுத்தூர் நாடாளுமன்ற உறுப்பினராக இருந்த காமராஜர் குடியாத்தம் தொகுதி சட்டமன்ற இடைத்தேர்தலில் போட்டியிட்டு வெற்றி பெற்று எம்.எல்.ஏ- வாகி இருக்கிறார்.
பிரதமர் மோடி
அதேபோல பிரதமர் மோடி குஜராத் முதல்வராக இருந்துக்கொண்டே 2014-ல் வாரணாசி தொகுதி எம்.பி ஆனார். அதன் பிறகு தனது முதல்வர் பதவியை ராஜினாமா செய்தார்.
தவிர எடியூரப்பா 2018-ல் லோக் சபை எம்.பி-யாக இருந்துகொண்டே முதல்வர் வேட்பாளராக கர்நாடகாவில் போட்டியிட்டார். அதன் பிறகு அவரது எம்.பி பதவியை ராஜினாமா செய்தார்.
போட்டியிட்ட அன்புமணி
தருமபுரி எம்.பி-யாக இருந்த அன்புமணி 2016 சட்டமன்றத் தேர்தலில் பென்னாகரம் தொகுதியில் பாமகவின் முதலமைச்சர் வேட்பாளராக போட்டியிட்டார்.
ஆனால் அந்தத் தேர்தலில் அவர் தோல்வியை தழுவி இருந்தாலும் தனது எம்.பி பதவியை ராஜினாமா செய்யாமல் இருந்ததால் அதே பதவியை மீண்டும் தொடர்ந்தார்.
இப்படி ஒருவர் நாடாளுமன்றத்தில் எம்.பி-யாக இருந்தாலும் சட்டமன்றத்தில் போட்டியிடலாம். சட்டமன்றத்தில் முதல்வர் மற்றும் எம்.எல்.ஏ-வாக இருந்தாலும் நாடாளுமன்றத்தில் போட்டியிடலாம். ஆனால் ஒரே சமயத்தில் இரண்டு பதவிகளையும் வகிக்க முடியாது என்பது குறிப்பிடத்தக்கது.
