The Supreme Court ruled on Friday that the freedom to walk on clearly defined and well-maintained footpaths is a fundamental right.
In a case concerning the death of a 5-year-old boy who was walking to school with his father and was hit by a lorry, the bench comprising Supreme Court judges B.S. Narasimha and A.S. Chandurkar delivered this verdict.
It was further stated in this judgment that, for pedestrians to walk safely, it is essential to have a footpath alongside the road. It is the duty of the authorities to clearly define that footpath and maintain it properly. The right to walk on the footpath is more important than the movement of motor vehicles.
Walking safely on wide footpaths is one of a person's fundamental rights. Citizens have the right to move freely throughout India.
It was held that it is necessary to establish a regulatory mechanism to promote and fully implement the fundamental right to walk on clearly defined footpaths.
