டெல்லி உயர் நீதிமன்றத்தின் ஆணையை தேர்தல் ஆணையம் அவமதித்ததாகவும், உச்ச நீதிமன்ற உத்தரவின்படி இரட்டை இலை சின்னத்தை நிலுவையில் உள்ள சிவில் நீதிமன்ற வழக்கு முடியும் வரை தடை செய்ய வேண்டும் என்று மீண்டும் கூறப்பட்டது.
இந்த முக்கிய வழக்கு டெல்லி உயர் நீதிமன்றத்தில் நீதிபதி சச்சின் தத்தா முன்பு கடந்த 16 ஆம் தேதி விசாரணைக்கு வந்தபோது வா.புகழேந்தி தரப்பில் ஆஜரான வழக்கறிஞர்கள், “புகார் கொடுத்து இரண்டு வருடங்களைக் கடந்தும் நடவடிக்கை எடுக்கவில்லை, தமிழ்நாடு சட்டமன்றத் தேர்தல் தேதி அறிவிக்கப்பட உள்ளது” என்று வாதிட்டனர்.
“புகார் மீது விசாரணை நடத்தினீர்களா? இன்னும் எவ்வளவு காலம் ஆகும்? எப்போது விசாரித்து தீர்வு காணப்படும்? உயர் நீதிமன்ற உத்தரவுக்குப் பின்னும் தாமதம் ஏன்?” என்று தேர்தல் ஆணையத்திடம் நீதிபதி பல்வேறு கேள்விகளை எழுப்பினார்.
“சரியான காலத்தை தெரிவிக்க முடியாது, இந்த விவகாரத்தில் விளக்கம் கேட்டு தெரிவிக்க கால அவகாசம் அளிக்க வேண்டும்” என்று தேர்தல் ஆணையம் தரப்பில் கோரப்பட்டது.
அதை ஏற்றுக்கொண்ட நீதிபதி, “இரட்டை இலை சின்ன விவகாரம் சம்பந்தமான புகார் மீது இதுவரை எடுக்கப்பட்ட நடவடிக்கைகள் குறித்து விளக்கம் அளிக்க வேண்டும்” என்று தேர்தல் ஆணைய வழக்கறிஞருக்கு அவகாசம் வழங்கி உத்தரவிட்டவர், வரும் பிப்ரவரி 23 ஆம் தேதிக்கு வழக்கை தள்ளி வைத்தார்.
